Beyond the Classroom Program — Full Terms of Use

We are so glad you are part of this program! By purchasing the Beyond the Classroom (BTC) Facilitator Kit, you (the "Purchaser") agree to the following terms on behalf of yourself and your group:
1. LICENSE GRANT
Heart of Gold for Kids™, LLC grants you a limited, non-exclusive, non-transferable license to use the BTC program materials — including the physical kit, digital portal content, facilitator guides, and activity pages — solely for educational use with the specific group enrolled in your purchase. This license is personal to the Purchaser and may not be assigned or transferred.
2. DEFINITION OF "GROUP"
"Group" means a single cohort of participants led by one facilitator completing one full cycle of the Beyond the Classroom program. A Group is limited to the specific participants enrolled at the time of purchase. Additional cohorts, sessions, or program runs require a separate kit purchase.
3. DIGITAL LICENSE DURATION AND ACCESS
Your digital portal access begins on the date of purchase and expires three (3) calendar months from that date (the "Access Period"). For example, a purchase made on June 1 expires on August 31 of the same year.
- Access automatically terminates at the end of the Access Period unless separately renewed by purchasing a new license.
- Downloaded materials, if permitted, are licensed for use during the Access Period only. Heart of Gold for Kids™, LLC does not guarantee the continued availability of downloaded files after the Access Period ends.
- Login credentials are personal to the Purchaser and may not be shared with other facilitators or groups.
4. ONE GROUP, ONE LICENSE
This license covers one Group as defined in Section 2. You may not use the same purchase to run the program simultaneously with multiple groups or in multiple locations. Each separate Group, session cohort, or program run requires its own kit purchase.
5. BOOKS ARE REQUIRED PER PARTICIPANT
Each participant in your Group must have their own copy of A Heart of Gold: The Greatest Gift. By agreeing to these terms, you confirm that you will purchase one book per participant and that books will not be shared between participants.
6. NO RESALE OR REDISTRIBUTION
You may not resell, transfer, sublicense, or donate this program or any of its components to another facilitator, group, organization, or individual. Physical materials (beach ball, notecards, stickers) are for use with your enrolled Group only and are not for resale.
7. NO COPYING OR REPRODUCTION
You may print digital activity pages and materials for participants in your enrolled Group only. You may not reproduce, photocopy, screenshot, or distribute digital materials to individuals outside your Group, post them publicly, share them via email lists or social media, or use them in any other program or setting not covered by this purchase.
8. INTELLECTUAL PROPERTY RIGHTS
All materials, programs, graphics, text, activities, facilitator guides, digital content, and related intellectual property made available through the Beyond the Classroom program are owned exclusively by Heart of Gold for Kids™, LLC and are protected by United States and international copyright, trademark, and intellectual property laws. The trademarks, service marks, and logos of Heart of Gold for Kids™ may not be used without prior written permission. Nothing in these terms transfers any intellectual property rights to the Purchaser. Unauthorized use of any Heart of Gold for Kids™ materials is strictly prohibited and may result in termination of access and legal action.
9. DISCLAIMER OF WARRANTIES
THE PROGRAM, MATERIALS, AND DIGITAL PORTAL ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HEART OF GOLD FOR KIDS™, LLC DOES NOT WARRANT THAT THE DIGITAL PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PROGRAM AND MATERIALS IS AT YOUR SOLE RISK.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEART OF GOLD FOR KIDS™, LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PROGRAM, MATERIALS, OR DIGITAL PORTAL. IN NO EVENT SHALL THE TOTAL LIABILITY OF HEART OF GOLD FOR KIDS™, LLC EXCEED THE TOTAL PURCHASE PRICE PAID BY YOU FOR THE FACILITATOR KIT THAT IS THE SUBJECT OF THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
11. TERMINATION
Heart of Gold for Kids™, LLC reserves the right to terminate your digital portal access and revoke your license at any time, with or without notice, if you violate any of these Terms of Use. Upon termination, you must immediately cease all use of the digital portal and program materials. Heart of Gold for Kids™, LLC shall not be liable for any refunds or compensation upon termination for cause.
12. WEBSITE TERMS OF USE
The following terms govern your use of heartofgoldforkids.com (the "Website") in addition to the program-specific terms above.
12.1 Permitted Use
You may access and use the Website for lawful purposes related to your use of
the Beyond the Classroom program and Heart of Gold for Kids™ products.
You may view and print materials from the Website solely for personal,
non-commercial use in connection with your licensed program.
12.2 Prohibited Conduct
You agree not to: (a) use the Website for any unlawful purpose or in violation
of applicable law; (b) scrape, crawl, or systematically extract data from the
Website; (c) attempt to gain unauthorized access to any portion of the
Website or its systems; (d) upload or transmit any harmful, offensive, or
disruptive content; (e) impersonate Heart of Gold for Kids™, LLC or any
employee, partner, or other user; or (f) use the Website in any manner that
could damage, disable, overburden, or impair its operation.
12.3 Third-Party Links and Availability
The Website may contain links to third-party websites. Heart of Gold for
Kids™, LLC does not endorse, control, or assume responsibility for the
content, privacy practices, or availability of any third-party sites. Use of
third-party sites is at your own risk. Heart of Gold for Kids™, LLC
makes no guarantee that the Website will be available at all times and
reserves the right to modify or discontinue any feature or content without
notice.
12.4 Account Security
You are responsible for maintaining the confidentiality of your account login
credentials. You agree to notify Heart of Gold for Kids™, LLC
immediately at team@heartofgoldforkids.com if you suspect unauthorized use of
your account. Heart of Gold for Kids™, LLC is not liable for any loss or
damage arising from your failure to safeguard your credentials.
12.5 Electronic Communication Consent
By creating an account or making a purchase on the Website, you consent to
receive electronic communications from Heart of Gold for Kids™, LLC,
including order confirmations, digital access notifications, and account
updates. These communications satisfy any legal requirement that
communications be in writing. You may opt out of marketing communications at
any time by following the unsubscribe instructions in those messages.
13. PRIVACY POLICY
Heart of Gold for Kids™, LLC is committed to protecting your privacy.
Information We Collect: We collect information you provide when making a purchase or creating an account, including your name, email address, billing and shipping address, and payment information. We also automatically collect your IP address and the date and time of your acceptance of these terms at checkout.
How We Use Your Information: We use your information to process orders, provide digital portal access, communicate with you about your account, and comply with legal obligations. We do not sell your personal information to third parties.
Data Retention: We retain purchase records and acceptance records (including timestamp and IP address) for a minimum of seven (7) years to satisfy legal and business requirements.

14. REFUND AND SHIPPING POLICY
14.1 Refunds
All sales are final. Due to the nature of digital access and physical kit
fulfillment, we do not offer refunds after purchase. If you have questions or
concerns about the program before purchasing, please contact us at
team@heartofgoldforkids.com. We are happy to help you determine whether this
program is right for your group.
Damaged or Incorrect Orders: If your physical kit arrives damaged or you receive an incorrect item, please contact us at team@heartofgoldforkids.com within 7 days of receipt with a description and photo of the issue. We will work with you to resolve the matter.
14.2 Shipping
Physical kit orders are shipped to the address provided at checkout. Heart of
Gold for Kids™, LLC is not responsible for delays caused by the carrier,
an incorrect address provided at checkout, or circumstances outside our
control. Shipping timelines are estimates only and are not guaranteed. For

15. GOVERNING LAW
These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
16. VENUE
Any legal action or proceeding arising out of or relating to these Terms of Use or your use of the program shall be brought exclusively in the state or federal courts located in Loudoun County, Virginia. You consent to the personal jurisdiction of those courts and waive any objection to venue in Loudoun County, Virginia.

Acceptance Record: Upon checking the required box at checkout, the customer's name, email address, IP address, order number, and date/time of acceptance are automatically recorded and stored with the order as evidence of agreement to these terms.
